Seller shall not be liable for delays occasioned by fires, strikes, accidents or other causes beyond its control.

No claim for allowance shall be recognized on other than new material, new product or new machinery where specific provision for such allowances are made by the manufacturer. Seller’s liability is limited to replacement as provided by the manufacturer under their warranties. Seller will not pay or be liable for labor, expense or damage resulting from use of any material sold hereunder.

Shipments and deliveries shall be subject to credit approval by Seller of the Buyer. If Buyer fails to fulfill the terms of payment, Seller may defer further shipments, or may, at its option, cancel existing orders or parts thereof. Seller reserves the right, previous to making any shipments, to require from Buyer satisfactory security for performance of Buyer’s obligations. No failure of Seller to exercise any right accruing from any default of Buyer shall impair Seller’s rights in case of any subsequent default of Buyer.

Where Buyer is to inspect merchandise purchased, inspection and acceptance must be made either before or on delivery date, otherwise the Buyer will forgo the right thereof. No claims for broken or damaged material will be accepted after the delivery has been made.

All taxes of any sort now or hereafter imposed by any State, Federal, Municipal, or other governmental agencies that may be levied against this transaction at any time now or in the future, are for the Buyer’s account.

After goods are delivered and signed for, our responsibility ceases. Title to ownership of all material on this invoice remains with Morris Industries Inc. until material is paid for in full. ALL CLAIMS FOR SHORTAGES AND ERROR MUST BE MADE ON RECEIPT OF GOODS OR BY THE END OF THE BUSINESS DAY IN WRITING.

No returns without written authorization. Special orders are non-returnable. There will be a 25% handling charge for merchandise returned.

WARNING: It is unlawful in the United States Of America (effective 1/4/2014) to use any product in the installation or repair of any public water system or any plumbing in a facility or system that provides water for human consumption if the wetted surface area of the product has a weighted average lead content greater that 0.25%. This prohibition does not extend to service saddles under USA Public Law 111-380. You are solely responsible for lawfully disposing of nonconforming leaded product.

Credit Card Terms and Conditions

By providing or entering your credit card information in any form:

• You are stating that you are an authorized user of the credit card and that the associated information entered (account holder name, account number, billing address, etc.) is accurate.
• You authorize Morris Industries, Inc. to charge the amount you have requested to your credit card.
• You also authorize Morris Industries, Inc. to return to your credit card any funds due to you by Morris Industries, Inc. resulting from use of this Service.

 Charges

• For each transaction, in addition to the charge you have authorized your credit card issuer and network may assess their customary transaction or handling charge, if any.
• If a charge is declined or reversed by the credit card issuer or network, you agree to pay us a service charge and to reimburse us for all reasonable costs of collection. Your credit card issuer may also assess its customary charge for such transactions.

Dishonored Requests for Payments

• If your credit card issuer or network does not honor the payment transaction, then we have the right to charge the amount of any such transaction to your account or to collect the amount from you.
• If your credit card issuer or network does not honor the payment transaction, we may terminate any or all Service, and we may cancel your right to participate in the online payment program.

Confirmation of Payment

• By clicking “Submit” and/or providing an email, you are consenting to receive a confirmation of this payment electronically to the email address you have provided to us.
